THE THING™ — TERMS OF SERVICE

Welcome to The Thing™.

These Terms of Service (“Terms”) govern your access to and use of The Thing™ website, online store, products, content, and related services (collectively, the “Services”).

By accessing our website, placing an order, or purchasing or using our products, you agree to these Terms. If you do not agree with these Terms, you should not use our Services or purchase our products.

These Terms are intended to operate in accordance with applicable laws of Puerto Rico and the United States.

1. About The Thing™

The Thing™ designs and sells specialty products intended primarily for recreational airsoft use, including 3D-printed chalk rounds and related products.

Our products are intended to create a visible chalk effect during appropriate recreational use.

Unless specifically stated otherwise, our products are not intended to be real ammunition, explosive devices, pyrotechnic devices, or products for use with actual firearms.

The Thing™ products must never be used with real firearms.

2. Eligibility

By purchasing from or using The Thing™, you represent that you are legally capable of entering into a binding agreement and legally permitted to purchase and possess the products ordered in your jurisdiction.

Where applicable, you are responsible for ensuring that you meet any minimum age requirement imposed by law, an airsoft facility, event organizer, shipping carrier, payment provider, or other applicable party.

We reserve the right to refuse or cancel an order when we reasonably believe the transaction violates applicable law, these Terms, or our policies.

3. Product Use

The Thing™ products are intended exclusively for their advertised recreational purposes.

Customers are responsible for:

  • Reading and following all product instructions and warnings.
  • Using appropriate safety equipment.
  • Following airsoft field and event rules.
  • Using products only with compatible equipment.
  • Inspecting products before use.
  • Ensuring that equipment is properly maintained.
  • Complying with applicable local and federal laws.
  • Using reasonable judgment and safe handling practices.

Products should not be intentionally fired at a person's head, face, eyes, or other vulnerable areas.

Appropriate protective equipment, including approved eye protection, should always be used during airsoft activities.

Never use a damaged, deformed, modified, or otherwise compromised product.

4. 40MM Products and Equipment Compatibility

Certain The Thing™ products may be designed for use with compatible airsoft 40mm launching systems.

The customer is responsible for verifying equipment compatibility before use.

Not every airsoft launcher, shell, system, or configuration is identical. Compatibility may depend on the equipment manufacturer, dimensions, operating system, configuration, condition, and other factors.

Do not force a product into equipment with which it does not properly fit.

The Thing™ is not responsible for damage resulting from use with incompatible equipment, unauthorized modifications, excessive pressure, improper loading, improper operation, or failure to follow applicable instructions.

5. Airsoft Use Only

Unless expressly stated otherwise, The Thing™ chalk rounds and related launching products are intended for airsoft and recreational simulation activities only.

They are not designed or approved for use as real firearm ammunition.

DO NOT load, chamber, fire, or attempt to use The Thing™ products in an actual firearm.

Do not modify The Thing™ products to contain hazardous, incendiary, explosive, toxic, harmful, or otherwise inappropriate materials.

6. Safety

Airsoft activities involve inherent risks.

Customers and users are responsible for understanding these risks and participating responsibly.

Never intentionally use The Thing™ products in a manner designed to cause injury, property damage, intimidation, or unlawful activity.

Users should maintain an appropriate distance consistent with the product, equipment, field rules, and circumstances.

Use The Thing™ products only in locations where airsoft activities and the applicable equipment are permitted.

7. 3D-Printed Products

Many The Thing™ products are manufactured using 3D-printing technology.

As a result, minor cosmetic characteristics may occur, including:

  • Layer lines.
  • Small surface variations.
  • Slight differences in texture.
  • Minor dimensional variations within manufacturing tolerances.
  • Minor color variations between production batches.

These characteristics may be normal consequences of additive manufacturing and do not necessarily constitute defects when they do not materially affect the intended function or advertised performance of the product.

8. Product Information

We make reasonable efforts to display product descriptions, colors, photographs, dimensions, and specifications accurately.

However, colors may appear differently depending on the customer's screen, device, lighting, production batch, or manufacturing process.

Product packaging, appearance, specifications, and designs may be updated from time to time.

Nothing in this section limits any rights consumers may have when merchandise materially differs from representations made at the time of purchase.

9. Orders

Submitting an order does not necessarily constitute final acceptance by The Thing™.

We reserve the right to refuse or cancel an order when reasonably necessary, including situations involving:

  • Suspected fraud.
  • Payment authorization problems.
  • Pricing or listing errors.
  • Product availability.
  • Shipping restrictions.
  • Suspected unlawful use.
  • Violation of these Terms.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

10. Pricing and Payment

Prices are displayed in U.S. Dollars (USD) unless otherwise stated.

Applicable taxes, shipping costs, and other charges will be displayed or calculated during checkout when applicable.

Customers agree to provide current, complete, and accurate billing and payment information.

Prices and promotions may change without notice, but changes will not retroactively alter the agreed price of an order already accepted except where permitted by applicable law.

11. Taxes

Customers are responsible for applicable taxes associated with their purchase.

Orders shipped to Puerto Rico may be subject to applicable Sales and Use Tax (IVU) and other legally required charges.

The Thing™ will collect applicable taxes where required.

12. Shipping and Delivery

Shipping estimates are provided for convenience and are not guarantees unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, transportation disruptions, incorrect addresses, or other logistical events.

Customers are responsible for providing an accurate and complete shipping address.

Customers should inspect their packages promptly upon delivery and contact us at info@sendthething.com if there is a problem with the order.

13. Returns and Refunds

Returns, refunds, damaged merchandise, defective products, and order cancellations are governed by our separate Return & Refund Policy.

The Return & Refund Policy forms part of these Terms.

Nothing in these Terms or our Return & Refund Policy is intended to waive consumer rights that cannot legally be waived under applicable Puerto Rico law.

14. Prohibited Uses

You may not use The Thing™ website, products, branding, or Services:

  • For unlawful purposes.
  • To intentionally injure another person.
  • To intentionally damage property.
  • With actual firearms unless a product is expressly designed and legally marketed for such use.
  • To create or facilitate explosive, incendiary, hazardous, or harmful devices.
  • To impersonate The Thing™.
  • To infringe intellectual property rights.
  • To engage in fraudulent transactions.
  • To interfere with the operation or security of our website.
  • In violation of applicable laws, regulations, field rules, or safety requirements.

We reserve the right to refuse service when we reasonably believe our products or Services are being used unlawfully or dangerously.

15. Modification of Products

Customers must not modify The Thing™ products in a manner that creates an unsafe condition.

Unauthorized modifications may affect product performance and may void applicable voluntary warranties or return eligibility to the extent permitted by law.

The Thing™ is not responsible for damage or injury caused by unauthorized modifications, misuse, or use outside the product's intended purpose, except where liability cannot legally be excluded.

16. Intellectual Property

All content associated with The Thing™, including but not limited to:

  • The Thing™ name.
  • Logos.
  • Product names.
  • Product designs to the extent protected by applicable law.
  • Artwork.
  • Graphics.
  • Photographs.
  • Videos.
  • Website content.
  • Packaging designs.
  • Advertising materials.
  • Original written content.
  • Brand slogans and creative assets to the extent legally protectable.

is owned by, licensed to, or otherwise used lawfully by The Thing™ and is protected to the extent provided by applicable intellectual property laws.

Nothing in these Terms grants permission to reproduce, sell, distribute, modify, imitate, or commercially exploit our protected intellectual property without prior written authorization.

17. Trademarks

THE THING™, associated logos, product branding, and other brand identifiers may be trademarks or claimed trademarks of their respective owner.

Use of our branding without authorization in a manner that creates confusion regarding sponsorship, affiliation, origin, or endorsement is prohibited.

18. User Content

If you submit photographs, reviews, comments, videos, testimonials, or other content to The Thing™, you represent that you have the right to submit that material.

Submitting content does not automatically transfer ownership of your content to The Thing™.

If we wish to use identifiable customer photographs or videos for advertising or promotional purposes beyond uses reasonably associated with the platform through which they were submitted, we may request appropriate permission when required.

19. Third-Party Services

Our website may use or link to third-party services, including payment processors, shipping providers, social media platforms, hosting providers, and other services.

The Thing™ does not control the independent operation, availability, security, or privacy practices of third-party services.

Use of those services may be subject to separate terms and policies.

20. Disclaimer of Warranties

To the maximum extent permitted by applicable law, our website and Services are provided on an “as available” basis.

Nothing in these Terms excludes warranties, guarantees, or consumer protections that cannot legally be excluded or waived under Puerto Rico or applicable federal law.

21. Limitation of Liability

To the maximum extent permitted by applicable law, The Thing™ will not be liable for indirect, incidental, special, or consequential damages resulting from misuse, unauthorized modification, incompatible equipment, improper handling, or use contrary to instructions.

The Thing™ does not seek to exclude liability that cannot legally be excluded under applicable law.

Nothing in these Terms limits rights or remedies available to consumers under mandatory Puerto Rico consumer protection laws.

22. Assumption of Risk

Airsoft and similar recreational activities may involve risks of personal injury or property damage.

By choosing to participate in these activities, users acknowledge the ordinary risks associated with the activity and agree to use appropriate protective equipment and safe practices.

This provision does not release The Thing™ from responsibility that cannot legally be waived.

23. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use, intentional misuse, or unauthorized modification of The Thing™ products or Services.

This provision does not apply to the extent a claim results from conduct for which The Thing™ is legally responsible.

24. Privacy

Personal information collected through our website or store will be handled according to our applicable Privacy Policy.

By using our Services, you acknowledge that certain information may be processed as necessary to fulfill orders, process payments, provide customer service, prevent fraud, and operate our business.

25. Electronic Communications

By contacting us electronically or placing an online order, you consent to receive transactional electronic communications relating to your purchase, including:

  • Order confirmations.
  • Payment notifications.
  • Shipping updates.
  • Customer service communications.
  • Return or refund communications.

Marketing communications will be handled according to applicable law and available opt-out mechanisms.

26. Puerto Rico Consumer Protection

These Terms are intended to operate consistently with applicable consumer protection requirements in Puerto Rico.

The Puerto Rico Department of Consumer Affairs (DACO) regulates commercial practices affecting consumers in Puerto Rico.

Nothing contained in these Terms is intended to waive or restrict any consumer right or remedy that cannot legally be waived.

Additional consumer information is available through the Puerto Rico Department of Consumer Affairs (DACO).

27. Governing Law

These Terms will be governed by applicable laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without limiting mandatory consumer protections that may apply.

Any dispute will be handled before the appropriate court, agency, or other forum having lawful jurisdiction.

Nothing in these Terms prevents a consumer from exercising applicable rights before DACO or another government agency when legally available.

28. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.

The remaining provisions will continue in effect.

29. No Waiver

Failure by The Thing™ to enforce a provision of these Terms on one occasion does not necessarily constitute a waiver of that provision or our right to enforce it in the future.

30. Changes to These Terms

The Thing™ may update these Terms periodically to reflect changes in our products, Services, operations, or applicable legal requirements.

The updated version will be posted with a revised “Last Updated” date.

Unless otherwise required by law, the Terms applicable to a transaction will generally be those in effect when the applicable order was placed.
